Hi Charles, Thanks a lot,
Just one more thing- My Sol now wants to put a proposal to the Court, saying that I want all the proceeds of the sale of FMH,
Is that feasable?
Ex is remarried, but lives alone in State provided accomodation, now
Please do let me know your words of wisdom,& knowledge too, Thanks, N

An open offer of settlement at any time might be useful to resolve a matter and avoid further expense but from a costs-recovery point of view (obtaining an order for costs from your ex in light of refusing a reasonable offer of settlement), the closer to trial the offer, the less likely it is to be taken into account.

As regards the remarried ex living in state accommodation, any settlement monies will likely interfere with benefits and benefits will cease upon receipt of monies until those monies are depleted and fall back within the permitted threshold.

Effectively, monies which would benefit you would be wasted on your ex who would not receive the benefit therefore it is better for you to receive all of the proceeds of sale and house yourself.
