Great, I am pleased that you are going to be proactive, I can be an ostrich myself, it is a lot harder when emotions and change is involved to be pro active!

Even on the barrister's advice:

You would be going for an order for sale, rather than a Mesher - on the higher percentage 70% of £440K is £308K and 50% of £140K is £70K giving a total of £378K. Very similar figure to 63% of the total assets that I suggested above. Lots of good arguments to support this, he would get his money earlier rather than having to wait under a Mesher Order etc. The exact percentage would need to be considered when you have details of your borrowing capacity and details of sale prices of houses.

I have not mentioned pensions, as I feel I can't comment on the exact split without the full facts and information of your case, other than to say consider the barrister's advice and your solicitor's advice on pensions, 30/70 may still be a realistic possibility.
