CMS, lies to HMRC

Have been divorced 10 years.

Currently in court for sm, so this has given me access to his accounts, well some of.

I know that CMS uses the info from HMRC. But I know that you have your gross income, then NET.

CMS uses the amount on NET to work out payment.

But looking at his accounts, self assessment. Before declaring his NET, he pays his mortgage, the CMS payments, gifts for hf, hotels, phone, also around £5000 of cheques he refuses to say what are for.

After all of that he said his NET. But net is the amount BEFORE you pay bills etc.

So surely he has made the net figure less.

Can I ask CMS for a full re assessment. And get him to pay what he should pay.

The first appointment meeting is Friday, so I’m saying that I’m not ready for FDR as he hasn’t been truthful and I suspect he’s doing this to pay less but also tax evasion.
He has made sure his NET is £10,500 just less that tax threshold

Do you have his tax return? That would have a tax calculation with it, which would show his accounts with only the permissible deductions.

CMS uses GROSS income to calculate the assessed amount.

Gross pay is before any reductions ie for National Insurance, Income Tax, pension contributions etc. Net is what you take home after those contributions have been made. And yes, from your information it does appear as though he has attempted to reduce his income probably for the purposes of your recent maintenance hearings. As another poster has pointed out, the CMS calculatations are on gross pay.

This may depend upon whether you are self employed or not.
It needs to be looked at with this in mind.
Gross 'take' as a self employed person is not the same as gross earnings. There are allowable expenses and therefore the GROSS figure referred to is in fact the money left after allowable expenses and which is declared to HMRC Then tax and NI will apply to that figure giving a net figure.
