kids are 11 and 12.

she says she wants money from any settlement as "well your never going to work again". I said I would make payments as per government child maintenance CSA. Can she do this?

Well Danny, you have to make child support payments in accordance with the CSA formula, but I'm sure you both knew that already.

As regards to her assets, the have to be dealt with as part of a divorce but it goes without saying you cannot pay money you do not have.

CSA doesn't take new cases it is indeed CMS now. You can find a calculator online to see what you would be assessed at.

You can't capitalise CM payments.
